About Destinations by Donna
Destinations by Donna LLC ("Destinations by Donna," "we," "us," or "our") operates as an independent travel booking agency. We act solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services ("Suppliers"). We are not the source or provider of travel services. Destinations by Donna is an Independent Contractor of Outside Agents, California Seller of Travel 2090937-50 (Registered Affiliate), Florida ST15578, Washington 603189022. Registration as a seller of travel does not constitute approval by the State of California.
Website Use and Intellectual Property
This website and all of its content, including but not limited to text, graphics, logos, images, and design elements, are the property of Destinations by Donna LLC and are protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission. You are granted a limited, non-exclusive, non-transferable license to access and use this website for personal, non-commercial purposes only. Any unauthorized use of this website or its content may violate copyright, trademark, or other applicable laws. We make reasonable efforts to ensure the accuracy of information presented on this website, but we make no warranties or guarantees that the content is complete, current, or error-free. We reserve the right to modify or remove any content at any time without notice.
Use of Services and Access to Travel Bookings
You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with Destinations by Donna. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you is true and accurate. Destinations by Donna accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation, and by booking travel through Destinations by Donna, you are also agreeing to the booking terms of each Supplier you have selected. We are not liable or responsible for any arrangements made independently of Destinations by Donna, including airline, hotel, excursion, and travel protection charges you arrange on your own. It may not be possible to earn frequent flyer or other loyalty points for reservations made through Destinations by Donna. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements we make on your behalf.
Payments, Cancellations, and Changes to Bookings
You are completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Destinations by Donna. By submitting a credit card authorization to Destinations by Donna, you agree to allow us to use your payment method to purchase travel products from our Suppliers on your behalf. Excepting in cases of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of Destinations by Donna or its Suppliers. If you attempt to chargeback, reverse, or recollect a previously authorized trip payment, Destinations by Donna reserves the right to collect all additional costs, fees, and expenses associated with such action, including attorney fees. All payments for travel are due prior to departure according to each Supplier's terms. Failure to make final payment may result in cancellation of your reservations or forfeiture of monies paid. In some cases, there is no refund once a booking is made and under deposit. All cancellation requests must be submitted to Destinations by Donna in writing. If you decide to change any portion of your confirmed arrangements, we will attempt to assist you. Certain bookings cannot be changed, and you will be responsible for any cost increases imposed by the Supplier as well as any change fees. All change requests must be made in writing to Destinations by Donna.
Travel Documents and Identification Requirements
It is the responsibility of each client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. The U.S. Transportation Security Administration (TSA) and Department of Homeland Security (DHS) advise that everyone carry acceptable identification to board a flight. Acceptable forms of identification can be found at www.tsa.gov. Certain countries will not admit a passenger if their passport expires within six months of the anticipated return date. Destinations by Donna neither controls nor warrants the issuance of visas or approval of visa waivers. Should a visa not be issued, Destinations by Donna is not responsible for lost payments made toward your trip. The name, date of birth, and gender on your identification must exactly match the data listed on your tickets and booking records. When you receive your travel documents, it is your responsibility to review and verify all information for accuracy. Contact Destinations by Donna immediately if any corrections are needed. If you do not notify us of necessary corrections within 24 hours of receiving your travel documents, Destinations by Donna bears no responsibility for any additional costs associated with making those corrections. Minors traveling with one parent or without both parents may be stopped and not admitted without authenticated consent forms. Individual Entry and Exit Requirements
Each country holds different views of past criminal offenses. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements before booking. We do not inquire about an individual's criminal record in the interest of respecting our clients' privacy. For further information, visit the U.S. State Department website at travel.state.gov.
Immunizations and Health Screenings
You must have the proper immunizations, health screenings, and required documentation before travel. Destinations by Donna shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at your final destination. If you are concerned about medications or certain inoculations, check with your health practitioner before booking. Risks and Safety
Travel to certain destinations may involve greater risk than others. Destinations by Donna urges clients to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel. By offering travel to particular destinations, Destinations by Donna does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result. Client participation constitutes acceptance of such events at the client's own risk. In the event of emergent health or safety concerns, Destinations by Donna shall have the sole and absolute discretion whether to proceed with any escorted trip or private departure, or to make alterations to the itinerary. Relevant safety resources can be found at state.gov, cdc.gov, and tsa.gov. U.S. citizens traveling abroad may also register their trip for free through the Smart Traveler Enrollment Program at step.state.gov.
Air Travel, Schedule Reconfirmation, and Check-In
Your airline ticket is a contract between you and the air carrier, even if you purchase through Destinations by Donna. Destinations by Donna does not have the right to control the operations of independent airlines and is not liable for any personal injury, property damage, delays, or irregularities caused by any airline, including their failure to deliver services, cancellation and refund policies, baggage fees, fuel increases, or cessation of operations. It is strongly recommended that you check in at least two hours before scheduled departure for domestic flights and three hours before for international flights. Reconfirm your flight times at least 24 hours in advance for domestic travel and 72 hours in advance for international travel. Failure to use a reservation may result in automatic cancellation of all continuing and return flights and forfeiture of airfares. Seat assignments are not guaranteed even after they are assigned, and Destinations by Donna has no control over airline seat assignments. Frequent flyer mileage accrual is at the discretion of the airline, and Destinations by Donna has no liability if accrual of miles or points is denied.
Limitations of Responsibility and Disclosure
Destinations by Donna acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity not subject to our control. Because Destinations by Donna does not have the right to control the operations of such independent operators and Suppliers, you agree that Destinations by Donna is not liable for any personal injury or property damage which may arise out of these services. Destinations by Donna disclaims any liability whether based on contract, tort, strict liability, or otherwise, including liability for any direct, punitive, special, consequential, incidental, or indirect damages in connection with goods or services provided by any Supplier. This includes any act, error, omission, injury, loss, accident, delay, or irregularity incurred through the fault or negligence of a Supplier or their employees, agents, or representatives, including their failure to deliver services, their cancellation and refund policies, fuel increases, bankruptcy, or cessation of operations. Destinations by Donna has solely received commission and fees for travel transactions. Client agrees that any recovery from Destinations by Donna will be limited to the amount of commission and fees actually received by Destinations by Donna.
Force Majeure
Destinations by Donna will not be in breach of these terms or otherwise liable to you for any failure or delay in performing an obligation under this agreement that is due to causes beyond its reasonable control. This includes acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown or malfunction of equipment, natural catastrophes including extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, or explosion. Each of Destinations by Donna's Suppliers have their own force majeure provisions. In the event of a force majeure, those Suppliers may, in their sole and absolute discretion, vary, postpone, or cancel any itinerary or arrangement. Any refund shall remain at the sole discretion of the Supplier, though Destinations by Donna will use reasonable efforts to secure reimbursement for you where possible. The purchase of travel insurance is highly recommended on all trips.
Client Conduct
Each participant on any trip escorted by Destinations by Donna is expected to act responsibly and adhere to all behavior guidelines established by Destinations by Donna and our Suppliers. Destinations by Donna and all local Suppliers reserve the right to remove you from any facility, tour location, or means of transportation if your conduct endangers yourself or others, disrupts the general well-being of other clients, or interferes with the operation or security of the places you visit. In any such case, there will be no refund. When you book with Destinations by Donna, you accept responsibility for any damage or loss caused by you. You must indemnify Destinations by Donna for the full amount of any claim, including legal costs, made against us. Baggage and personal effects are at all times the sole responsibility of the participant.
Travel Insurance
Destinations by Donna offers access to travel insurance to protect passengers and their investment in travel. Unless specifically noted, travel insurance is not included in the cost of your itinerary. Travel insurance may protect against Supplier default or bankruptcy, delay, interruption, cancellation, medical emergency transportation, evacuation, repatriation, lost luggage, illness, job loss, accidental death and disability, and more. Without appropriate travel insurance, you understand that if you cancel or interrupt your travel for any reason, portions of the trip may not be refunded and cancellation penalties from Destinations by Donna and Suppliers will apply. The purchase of travel insurance is not required, but if you decline, Destinations by Donna may require you to sign an insurance waiver. Destinations by Donna is not a licensed insurance broker and cannot guarantee that any insurance provider will approve coverage for a claim.

General Provisions
The laws of the State of Indiana govern these terms and conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Fulton County, Indiana in all disputes arising out of or relating to travel bookings with Destinations by Donna. Any claim against Destinations by Donna must be brought within 12 months after the completion of the trip. Destinations by Donna shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. You agree that you may only bring claims in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding. If any part of these terms is determined to be invalid or unenforceable, that provision will be deemed superseded by a valid provision that most closely matches the intent of the original, and the remainder of these terms shall continue in effect.
